An Enduring Power of Attorney
An Enduring Power of Attorney provides for your financial and business affairs to be looked after by your Attorney when you lose capacity to do those things for yourself.
You, the Grantor, grant authority to an Attorney (someone you trust) to act on your behalf to manage your financial and business affairs. This does not include personal matters which are covered by an Appointment of Enduring Guardian document.
An Enduring Power of Attorney (“EPA”) in New South Wales is a legal document governed by the Powers of Attorney Act 2003 (NSW) that allows you to appoint someone to make legal and financial decisions on your behalf when you are unable to do so.
It is important to know that this authority continues when you lose capacity to manage your own affairs and cannot be revoked if you have lost legal capacity.
The Enduring Power of Attorney ceases to be effective upon your death when your Will becomes the effective document.
